The activities of the institution of the commissioner for children’s rights as an element of the development of the state of law and the system of social protection of children in the Russian Federation
Abstract
The article describes the specifics of the institution of the Commissioner for Children’s Rights, its main functions, its place in the system of protecting the rights of children.
The article shows the features of the formation and functioning of this institution in the world practice and in Russia, the specifics of the legal and social status of the Commissioner for children's rights, its interaction with other organizations and systems. The authors emphasize that the introduction of this position in the system of social protection of children is a progressive step in the establishment of the state of law, since human rights and social institutions can not always solve the problems of protecting children's rights.
At the same time, the activity of this Institute is most often advisory in nature, the purpose of which is not to force, but to convince the authorities, social and other institutions of the need for measures to improve the situation and realize the rights of children. In his activity the Commissioner is somehow ahead, reflecting the trends in the state children’s policy.
The main directions of the activity of the institute of the commissioner are analyzed, as well as those aspects that are still debatable and beyond the scope of research are indicated. Most often, this is an assessment of the activities of the Commissioner and his perception of public opinion.
According to the authors, the institution of the Commissioner for Children’s Rights in Russian Federation is in its infancy but is already active and is included in the system of protection of children’s rights. The purpose, the functions of the social institution, the content of social roles, values and norms are defined. This institution has acquired a kind of hybrid form, something in between state and public organizations.
